| 内容記述 | This study aims to compare the Korean Sports Basic Law and the Japanese Sports Basic Law. The results are summarized as follows: In December 1999, the Korean Association of Sports Law argued the necessity of the Sports Basic Law while advocating the establishment of a sports legal system. After that, through the researches on foreign Sports Basic Laws and the proposals by members of Parliament, the Korean Sports Basic Law was enacted on August 10, 2021 by integrating and adjusting the two Sports Basic Laws (Lee Yong's the Sports Basic Law of People Power Party and Park Jong's the Sports Basic Law of The Minjoo Party of Korea). And it has been in effect since February 11, 2022. In addition, sports rights are stipulated as the basic rights of the people in Korean Sports Basic Law. This is not seen in sports-related laws in South Korea, and can be interpreted as the advancement of Korean sports laws. As far as the Korean Sports Basic Law is concerned, Korean sports are moving away from the elite sports and win at all costs, and aiming for sports that everyone can enjoy freely and equally. Sports policy in South Korea had been used as a means to maintain and publicize a specific government. Therefore, the reform will of all people engaged in sports including the national and local governments is required in order to realize the goal of Korean Sports Basic Law. | |||||||||||||||||

| 内容記述 | 本稿の目的は、韓国のスボーツ基本法を考察することである。その結果をまとめると次のとおりである。韓国におけるスボーツ基本法は、1999年12月韓国スボーツ法学会がスボーツ法体系の整備を主張しながらスボーツ基本法の必要性を主張したのが嚆矢であった。その後、20年にわたるスボーツ基本法に関する研究や国会議員らによる発議などを経て、 2021年8月10日、二つのスポーツ基本法案（国民の力党所属の李鏞議員が代表発議したスボーツ基本法案と共に民主党所属の朴釘議員が代表発議したスボーツ基本法案）を統合・調整した「スボーツ基本法」が制定され、2022年2月11日から施行されていた。韓国のスボーツ基本法ではスボーツ権が国民の基本権として規定されていた。これは従来の韓国におけるスボーツ関連法では見られなかったものであり、韓国のスボーツ法の先進性がうかがえる。また、韓国のスポーツ基本法を見る限り、いま韓国のスボーツは勝利至上主義やエリート体育を止揚し、全ての国民がスボーツを享受するスボーツを志向しており、大きな転換期を迎えている。しかしながら、韓国のスボーツ政策は特定政権を維持・広報する手段として用いられてきた側面があり、今後スボーツ基本法を実現するためには国家及び地方自治団体をはじめ、スボーツに従事する全ての人々の意識改革が求められる。 | |||||||||||||||||
